"IRS SCANDAL" Lois Lerner does about-face, will give Hill testimony on IRS scandal

Former Internal Revenue Service official Lois Lerner, a central figure in the IRS scandal, will appear before Congress Wednesday after refusing to testify last year on the matter, Rep. Darrell Issa, R-Calif., said Sunday.
Issa, chairman of the House Committee on Oversight and Government Reform, told “Fox News Sunday” that Lerner’s lawyers said she will testify before his committee, after saying last week that she would not.
“It’s going to be a good, fact-finding hearing,” he said.
Issa said he didn’t know why Lerner’s lawyers changed their mind, but suggested Lerner testifying was “in her best interest,” considering the recent evidence the committee had gathered.
Issa and Lerner’s attorneys have argued about whether she is protected under the Fifth Amendment from having to testify.
In May 2013, Lerner invoked the amendment right during her first-and-only appearance before the House committee, but only after she professed her innocence during an opening statement.
Lerner resigned last year from her role as the agency’s director of tax-exempt organizations.
The House committee continues to investigate the IRS in its 2012 targeting of Tea Party groups and other politically conservative organizations trying to get tax-exempt status.  
Congressional investigators are trying to determine who exactly gave the orders for IRS agents to target the groups.
Issa said Sunday that Lerner was “in a powerful position and could have been acting alone.” Congressional documents also suggest that she was under political pressure to orchestrate the targeting.
However, safeguards against such situations should have been in place and Congress should work to put in “more checks and balances,” he also said.

Democratic senators push to cap political activities of tax-exempt groups

A group of Democratic senators on Thursday called on the Obama administration to limit the political activities of organizations claiming tax-exempt status, asking to cap the amount at 5 to 15 percent of the groups' overall efforts.
The 15 senators, in public comments on proposed regulations developed by the Obama administration in the wake of the IRS targeting scandal, said the rules need to ensure that tax-exempt groups can't use their status to go around campaign finance rules, The Hill reported.  
"You will undoubtedly receive complaints from certain corners that these proposed rules will infringe on First Amendment speech rights," Sens. Charles Schumer, D-N.Y., Sheldon Whitehouse, D-R.I., and other senators told the Treasury Department and the IRS. 
"Such complaints are without merit: these rules would not restrict anyone’s right to speak, or to spend money to influence elections," the senators wrote. "If implemented properly, the rules will only close a loophole that has until now allowed donors to evade campaign finance law disclosure requirements."
In November, Treasury and the IRS issued draft regulations that would limit the political activities of such groups that fall under section 501(c)4 of the tax code. The proposed regulations have attracted more than 98,000 public comments — a record, according to the IRS.
Republicans accused the Obama administration of trying to legalize the targeting of conservative groups. The GOP-led House on Wednesday voted in favor of a bill that would "put a hold" on the proposed rules until Congress and the Treasury Department's inspector general complete their investigations of the IRS targeting scandal. 
The White House has said President Obama's top advisers will urge him to veto the bill if it reaches his desk, although majority Democrats in the Senate are expected to prevent it from getting a vote there. 
The lack of clarity under the current standards "has resulted in confusion and difficulty administering the (tax) code, as well as delays in the processing of applications for tax-exempt status," the White House said. 
According to The Hill, the Democratic senators also urged Treasury and the IRS to exempt nonpartisan voter registration efforts from the definition of "candidate-related" political activity, which covers certain communications and election activities.
Meanwhile, the U.S. Chamber of Commerce on Tuesday called on Treasury and the IRS to withdraw the "fundamentally unsound" regulations, arguing the administration is attempting to create a "no speech zone" for certain tax-exempt groups.
“This unworkable proposal demonstrates the obvious: the IRS has neither the expertise nor the authority to regulate First Amendment political speech, and should not be used by the administration for political ends," said Lily Fu Claffee, the Chamber's general counsel and chief legal officer.

Ever since Russell George, the Treasury inspector general, filed a report confirming that the IRS targeted conservative groups last year, congressional Democrats have maintained that it was “fundamentally flawed.”
Now, in response to a separate meeting that George held with Republican staff last month, two representatives have filed a 22-page ethics complaint against him. From The Hill:
Rep. Elijah Cummings (Md.), the top Democrat on the House Oversight and Government Reform Committee, and Rep. Gerry Connolly (D-Va.) are sharply criticizing George for agreeing to brief GOP staff at a late January meeting on the Affordable Care Act without Democrats in attendance.
In their complaint, Connolly and Cartwright question the integrity of George’s inquiry into the IRS targeting from the start of his inquiry.

During a congressional hearing into the Internal Revenue Services’ admitted targeting of conservative groups prior to the 2012 election cycle, an attorney representing some of those groups severely chastised President Barack Obama for asserting during an interview with Fox News Channel host Bill O’Reilly that there was not a “smidgen” of corruption at that agency. After citing a number of items of evidence which support the claim that the IRS unfairly targeted conservative groups, attorney Jay Sekulow said that the IRS scandal goes “as high as it gets.”
Rep. Ron DeSantis (R-FL) began by asking attorney Cleta Mitchell if she agreed with the president’s argument that the IRS was targeting both liberal and conservative groups with undue scrutiny.
“Absolutely false,” Mitchell replied. She cited a report which revealed that of 162 organizations being scrutinized by the IRS, 83 percent of them were conservative groups. She went on to identify an instance where one of those liberal groups was approved much faster than the conservative group, prompting laughs from the assembled members of Congress.
Sekulow turned to focusing on the “chilling effect” that has resulted from the IRS’s targeting of conservatives. He cited a pro-life group that was scrutinized and asked “draconian” questions about that group’s mission.
Sekulow read from a document questioning the logic and methodology of that pro-life group’s mission. The IRS agent criticized that group for making conclusions “more on the basis of strong emotional feelings than objective valuations.”
“Who gave the IRS the authority to say this?” Sekulow asked. “And how is it that the president of the United States can say there’s not a smidgen of corruption?”
